New Charges Filed in Manhattan Federal Court

The new charges were presented in a superseding indictment in Manhattan federal court in New York. A superseding indictment is a revised legal document that adds to or changes charges in an existing criminal case.

According to US prosecutors, the new indictment accuses Maduro and Flores of participating in a conspiracy to commit torture. It adds to earlier allegations involving narcoterrorism, cocaine importation and weapons offences.

The prosecution claims that the alleged acts of abuse were part of a wider system used to silence political opponents and protect those in power. The indictment describes alleged cases involving Venezuelan detainees as well as US citizens held in Venezuela.

The defendants have denied the earlier charges. As of October 8, they had not yet entered pleas to the new torture charge.

What Are the Torture Allegations?

US prosecutors allege that at least nine people, including three American citizens, were subjected to torture or related abuses under the system described in the indictment.

The alleged methods include electric shocks, beatings, asphyxiation, forced injections and psychological abuse. Prosecutors also claim that some detainees faced threats against their families.

The indictment alleges that Maduro directed, approved or received regular updates about certain acts of abuse. Flores is accused of helping develop the alleged system of repression and ordering torture in some cases.

These claims form part of the prosecution’s case and have not been established as findings at trial. The court proceedings will determine whether the evidence supports the charges against each defendant.

Alleged Abuse of Political Opponents

The indictment describes alleged acts of detention, violence and torture in Venezuela over a period extending from 1999 to 2025. According to prosecutors, the alleged system was used to target people suspected of opposing Maduro or his government.

One case cited in the indictment concerns a Venezuelan military officer who was arrested and interrogated in 2013 over suspicions of involvement in a coup plot. Prosecutors also describe the case of a US citizen detained in Venezuela in 2022 and accused of conspiring to assassinate Maduro.

The allegations include claims that state security agencies and other groups were involved in detaining and abusing people considered threats to the government.

The new charges broaden the legal case by placing alleged torture alongside the existing accusations related to narcotics and weapons. However, the prosecution must still establish the defendants’ individual responsibility through the US judicial process.

Maduro and Flores Remain in US Custody

Maduro and Flores were captured in Caracas on January 3, 2026, during a US military operation and taken to New York to face criminal charges. Their capture and transfer have also drawn international attention because of the legal and diplomatic questions surrounding the operation.

Both are being held at the Metropolitan Detention Center in Brooklyn, New York.

Flores requested release on bail, with her lawyers citing health concerns. However, US District Judge Alvin Hellerstein denied her request. The court proceedings will continue while the defendants remain in custody.

Their trial is scheduled to begin on June 1, 2027. The new indictment adds another serious allegation that prosecutors will seek to establish through evidence and legal arguments.

Possible Prison Sentences

The defendants face several charges under the superseding indictment, including conspiracy to commit torture, narcoterrorism conspiracy, conspiracy to import cocaine and weapons-related offences.

According to the US Department of Justice, the torture-conspiracy charge carries a maximum sentence of 20 years in prison. Other charges carry different penalties, including mandatory minimum sentences for specified offences and possible life imprisonment.

The actual sentence, if either defendant is convicted, would depend on the charges proven, the applicable law and the court’s sentencing decision. The filing of charges does not mean that a person has been found guilty.

Who Are Nicolás Maduro and Cilia Flores?

Nicolás Maduro became president of Venezuela in 2013 after the death of Hugo Chávez, who had led the country for many years. Before becoming president, Maduro held government positions, including serving as foreign minister.

Cilia Flores is a Venezuelan political figure who previously served as attorney general and led the country’s National Assembly before becoming first lady.

The new indictment accuses both of involvement in a system of repression and torture. Their lawyers have challenged the case, and the allegations will be examined during the court proceedings.
