Live-In Not Crime SC: Court Rejects Criminal Charges

A bench of Justices B V Nagarathna and Ujjal Bhuyan stated that a voluntary relationship cannot later be treated as a criminal act. The woman had accused her former partner of sexual exploitation after he married another woman. However, the court said that emotional pain alone cannot turn a consensual relationship into a criminal case.

Court Examines Consent in Relationship

The judges noted that the woman had willingly stayed in the relationship for many years and even had a child. They questioned how such a relationship could later be called sexual assault. The woman’s lawyer argued that she was misled by a promise of marriage and entered the relationship at a young age. Still, the court clarified that it can only deal with legal aspects, not personal moral issues.

Child’s Rights Stay Protected

Even though the court refused criminal proceedings, it clearly stated that the child’s rights remain safe. The woman can seek maintenance for her eight-year-old child under Section 125 of the Criminal Procedure Code. The bench also agreed to consider the issue of child support separately.

Legal View on Live-In Relationships

In India, live-in relationships have limited legal recognition. Laws like the Protection of Women from Domestic Violence Act, 2005 offer some protection to women in such relationships. However, they do not have the same legal status as marriage. Courts have repeatedly said that consenting adults have the freedom to choose such arrangements.

Live-in relationships remain a topic of debate in Indian society. While courts support individual choice, disputes often arise when relationships end, especially where children and financial matters are involved. The latest observation by the court highlights the importance of consent and separates legal responsibility from moral concerns.
